AI-Generated Content Disclosure

You acknowledge and agree that:

1. Descriptions are created by AI systems based solely on the information you provide
2. AI-generated content may contain errors, inaccuracies, or omissions
3. AI systems may occasionally produce unexpected or inappropriate content despite our safeguards
4. The quality and accuracy of descriptions depend significantly on the quality and accuracy of the information you provide
5. You are solely responsible for reviewing, editing, and approving all descriptions before use
6. Nila June does not guarantee that any description will be suitable for your specific needs or purposes

Fair Housing Compliance Disclaimer

Nila June's service is designed to help real estate professionals create property descriptions while avoiding terminology that may violate fair housing laws. Our AI systems are programmed to avoid over 150 terms and phrases commonly flagged as potentially discriminatory under the Fair Housing Act and similar state and local laws.

HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT:

1. Nila June does not provide legal advice. Our service is not a substitute for consultation with a qualified attorney regarding fair housing compliance.
2. Nila June does not guarantee fair housing compliance. While our AI is designed to avoid potentially problematic language, no automated system can guarantee compliance with all federal, state, and local fair housing laws, which vary by jurisdiction and are subject to change and interpretation.
3. You are solely responsible for fair housing compliance. As the real estate professional using our descriptions, YOU bear full legal responsibility for ensuring that any property description you publish or distribute complies with the Fair Housing Act, state fair housing laws, MLS rules, and all other applicable laws and regulations.
4. You must review all descriptions for compliance. You agree to carefully review every description generated by our service before use to ensure it does not contain any language that could be construed as discriminatory based on race, color, religion, national origin, sex, familial status, disability, or any other protected class under applicable law.
5. Nila June is not liable for fair housing violations. Under no circumstances shall Nila June be liable for any fair housing complaint, claim, fine, penalty, lawsuit, or other legal action arising from your use of descriptions generated by our service.
6. You indemnify Nila June for fair housing claims. You agree to indemnify, defend, and hold harmless Nila June from any and all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from any alleged fair housing violation related to descriptions you obtained through our service.

Ownership of Generated Descriptions

Upon delivery of a property description and, if applicable, payment of any required fees:

1. You own the description. Nila June assigns to you all right, title, and interest in the generated description. You may use, modify, publish, and distribute the description as you see fit.
2. Nila June retains no rights. We do not retain any ownership interest in descriptions delivered to you. We will not use, sell, license, or distribute your descriptions to third parties.
3. You are responsible for the description. Once a description is delivered to you, you assume full responsibility for its content and any use you make of it.

Your Responsibilities

By using our service, you represent and warrant that:

1. You are a real estate professional or are otherwise authorized to create property descriptions for the properties you submit
2. You have the right to submit the property information you provide to us
3. All information you provide is accurate and complete to the best of your knowledge
4. You will review all generated descriptions before use
5. You will not use our service for any unlawful purpose
6. You will comply with all applicable laws, including fair housing laws, when using descriptions generated by our service
7. You will not hold Nila June responsible for any errors, omissions, or legal issues arising from your use of generated descriptions

Your Email and Usage

Your email address is used to identify you across sessions, track your usage, and deliver your descriptions. You are responsible for:

• Providing a valid professional email address
• All activity associated with your email address on our platform
• Notifying us immediately if you believe someone is using your email address without authorization

We reserve the right to restrict or block access to any email address at our sole discretion.

Payment and Pricing

Prices for our services are listed on our website and are subject to change. All payments are processed securely through Stripe. By making a purchase, you agree to pay the listed price plus any applicable taxes.

Refund Policy

If you are dissatisfied with a property description, you may request a refund under the following conditions:

1. You must contact us within 24 hours of receiving the description
2. You must agree not to use any part of the description for any purpose
3. Refunds will be processed within five (5) business days

Arbitration Agreement

Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.

Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association. The arbitration shall take place in New Jersey or another location mutually agreed upon. The arbitrator's decision shall be final and binding.

Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration against Nila June.
